Council Meeting Minutes — March 28, 2016

MINUTES OF THE REGULARLY SCHEDULED BENTON CITY COUNCIL MEETING ON MARCH 28, 2016 AT 6:00 P.M. IN THE BENTON MUNICIPAL BUILDING LOCATED AT 500 WEST MAIN STREET, BENTON, ILLINOIS.

MAYOR KONDRITZ CALLED THE MEETING TO ORDER AND DIRECTED ROLL TO BE CALLED. THOSE PRESENT WERE COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ.

COMMISSIONER MILLER MADE A MOTION TO WAIVE READING OF AND APPROVE THE MINUTES FROM THE MARCH 14, 2016 REGULAR COUNCIL MEETING. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER BAUMGARTE MADE A MOTION TO APPROVE PURCHASE ORDER #002586 TO HD SUPPLY FOR 24 5/8” I PEARL METERS IN THE AMOUNT OF $3,000.00. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER BAUMGARTE MADE A MOTION TO APPROVE PURCHASE ORDER #001029 TO DISPLAYS TO GO FOR ONE 4-TIER ACRYLIC LITERATURE RACK IN THE AMOUNT OF $149.77. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER WYANT MADE A MOTION TO HIRE BRIAN PARKS AS A SEASONAL EMPLOYEE TO WORK 5 DAYS A WEEK, 40 HOURS A WEEK. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 3. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, AND MAYOR KONDRITZ. NAYS: 0. COMMISSIONER MILLER ABSTAINED.

COMMISSIONER MILLER PRESENTED PAYROLL FOR MARCH 25, 2016 FROM THE GENERAL FUND IN THE AMOUNT OF $56,543.90, FROM THE WATER AND SEWER FUND IN THE AMOUNT OF $28,557.31, AIR AIRPORT CARETAKER IN THE AMOUNT OF $850.00 FOR A TOTAL PAYROLL OF $85,951.21. COMMISSIONER MILLER MADE A MOTION TO APPROVE THIS PAYROLL. SECOND BY COMMISSIONER WYANT. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER MILLER PRESENTED A SEWER ADJUSTMENT FOR LISA SUMMERS OF 901 MCKENZIE. COMMISSIONER MILLER MADE A MOTION TO APPROVE THESE SEWER ADJUSTMENTS AS PRESENTED. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER MILLER MADE A MOTION TO APPROVE THE DATES OF APRIL 14, 2016 AND APRIL 21, 2016 FOR THE CITY OF BENTON RETREAT. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

ATTORNEY MALKOVICH STATED THAT AGE (AFFORDABLE GAS AND ELECTRIC) HAD PROVIDED THE CITY WITH ELECTRICITY RATES AND THAT THE CITY NEEDED TO DECIDE ON A TERM FOR THE CONTRACT. THE RATES PROVIDED WERE $0.047/KWH FOR 1 YEAR, $0.048/KWH FOR 2 YEARS, AND $0.049/KWH FOR 3 YEARS. COMMISSIONER BAUMGARTE MADE A MOTION TO SIGN A CONTRACT FOR 3 YEARS WITH A RATE OF $0.049/KWH. SECOND BY COMMISSIONER WYANT. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

MAYOR KONDRITZ STATED THAT THE IMPROVEMENTS AT TWIN OAKS ARE PROCEEDING AND THAT LAKE COVE RESORT HAS TAKEN OVER RESERVATIONS AT THIS TIME. MAYOR KONDRITZ STATED THAT IN DECEMBER THE CITY WILL BE HAVING A “WINTER WONDERLAND” AT TWIN OAKS.

MAYOR KONDRITZ ALSO STATED THAT AS AN UPDATE, THERE ARE INTERESTED PARTIES LOOKING AT LAND IN INDUSTRIAL PARK II.

MAYOR KONDRITZ STATED THAT LARRY AND CAROLYN DARR HAVE PURCHASED THE PROPERTY AT 502 NORTH STUYVESANT AND CLEANED THIS PROPERTY UP. IT HAS COME TO THE ATTENTION OF THE MAYOR THAT THIS PROPERTY HAS NOT BEEN ZONED. COMMISSIONER BAUMGARTE MADE A MOTION TO ZONE THE PROPERTY AT 502 NORTH STUYVESANT AS “R4”. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

MAYOR KONDRITZ STATED THAT THERE IS A FEE THAT HAS BEEN CHARGED TO REZONE PROPERTIES IN THE PAST. IT WAS MAYOR KONDRITZ’S RECOMMENDATION TO NOT CHARGE A FEE IN THIS INSTANCE BECAUSE WE WERE NOT REZONING THIS PROPERTY. COMMISSIONER MILLER MADE A MOTION TO CHARGE NO FEE TO LARRY AND CAROLYN DARR FOR THE ZONING OF PROPERTY AT 502 NORTH STUYVESANT. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

MAYOR KONDRITZ STATED THAT MR. AND MRS. DARR WOULD LIKE TO HAVE A SPECIAL USE PERMIT IN ORDER TO BRING A MOBILE HOME ONTO THE PROPERTY AT 502 NORTH STUYVESANT. COMMISSIONER WYANT MADE A MOTION TO APPROVE A SPECIAL USE PERMIT FOR 502 NORTH STUYVESANT. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

MAYOR KONDRITZ STATED THAT THE CITY NEEDS TO REIMBURSE THE COUNTY FOR THE ENTERPRISE ZONE ANNUAL FEE. THE TOTAL FEE IS $300.00 THE COUNTY WILL PAY $200.00 OF THE FEE AND THE CITY WILL REIMBURSE THE COUNTY $100.00. COMMISSIONER MILLER MADE A MOTION TO REIMBURSE FRANKLIN COUNTY $100.00 FOR THE ENTERPRISE ZONE ANNUAL FEE. SECOND BY COMMISSIONER BAUMGARTE.

MAYOR KONDRITZ PRESENTED MINUTES FROM THE PLANNING COMMISSION FOR THE DATES OF AUGUST 17, 2015 AND DECEMBER 21, 2015 ALONG WITH PUBLIC HEARING MINUTES FROM AUGUST 17, 2015. COMMISSIONER BAUMGARTE MADE A MOTION TO APPROVE THESE MINUTES AS PRESENTED. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER MILLER, AND MAYOR KONDRITZ. NAYS: 0.

MAYOR KONDRITZ STATED THAT HE WOULD LIKE TO BEGIN A TIRE RECYCLING PROGRAM IN THE CITY OF BENTON DURING THE MONTH OF MAY. MAYOR KONDRITZ STATED THAT HE WOULD LIKE TO DO THIS IN ORDER TO HELP PREVENT THE SPREAD OF THE ZIKA VIRUS. COMMISSIONER BAUMGARTE STATED THAT BEFORE THE CITY BEGINS COLLECTING TIRES HE WOULD LIKE TO SPEAK WITH THE EPA. MAYOR KONDRITZ STATED THAT THIS MATTER WOULD BE TABLED AT THIS TIME.

MAYOR KONDRITZ STATED THAT ITEMS (F), (G), (H), (I), AND (J) ARE FOR DISCUSSION IN EXECUTIVE SESSION.

NO MISCELLANEOUS BUSINESS.

UNDER OLD BUSINESS, COMMISSIONER MILLER ASKED THE COUNCIL WHERE WE WERE WITH SCHEDULING NOVACARE TO DO JOB ANALYSIS. MAYOR KONDRITZ STATED HE WOULD LOOK INTO THIS AND GET BACK TO THE COUNCIL.

IN MATTERS FROM THE PUBLIC AUDIENCE, ROCKY MORRIS ASKED IF THE COUNTY’S RECYCLING COORDINATOR COULD HELP WITH A TIRE RECYCLING PROGRAM IN THE CITY OF BENTON.
