MINUTES OF THE BENTON CITY COUNCIL MEETING HELD MONDAY FEBURARY 9, 2015 AT 7:00 P.M. IN THE BENTON MUNICIPAL BUILDING LOCATED AT 500 WEST MAIN STREET, BENTON, ILLINOIS.

MAYOR KRAFT CALLED THE MEETING TO ORDER. THOSE PRESENT WERE COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER BURNETT, COMMISSIONER MILLER, AND MAYOR KRAFT.

COMMISSIONER MILLER MADE A MOTION TO APPROVE MINUTES OF THE JANUARY 26, 2015 BENTON CITY COUNCIL MEETING. SECOND BY COMMISSIONER BURNETT. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER BAUMGARTE, COMMISISONER WYANT, COMMISSIONER BURNETT, COMMISSIONER MILLER, AND MAYOR KRAFT. NAYS 0.

COMMISSIONER WYANT MADE A MOTION TO UPDATE THE STREET/ALLEY/CORPORATE LIMIT MAP BY SHAWNEE PROFESSIONAL SERVICES. ESTIMATED COST OF THIS PROJECT IS BETWEEN $1,500.00 AND $2,000.00. COMMISSIONER BURNETT PRESENTED THE FIRE DEPARTMENT REPORT FOR JANUARY 26, 2015 THROUGH FEBRUARY 8, 2015. THE FIRE DEPARTMENT HAD 8 FIRST RESPONDER CALLS, 3 FALSE ALARMS, 1 STRUCTURE FIRE, AND 1 BRUSH FIRE FOR A TOTAL OF 13 CALLS. ALL ENGINES ARE IN SERVICE.

COMMISSIONER BURNETT PRESENTED THE POLICE DEPARTMENT REPORT FOR JANUARY 23, 2015 THROUGH FEBRUARY 4, 2015. THE BENTON POLICE DEPARTMENT HANDLED A TOTAL OF 167 DISPATCH CALLS FOR SERVICE. THESE INCLUDED 6 TRAFFIC ACCIDENTS, 20 TRAFFIC STOPS, 7 DOMESTIC DISPUTES, 9 THEFT REPORTS, AND SEVERAL OTHER CALLS FOR SERVICE. THE DEPARTMENT COMPLETED A TOTAL OF 46 WRITTEN REPORTS.

COMMISSIONER BURNETT STATED THAT HE HAD A MATTER FOR DISCUSSION IN EXECUTIVE SESSION.

COMMISSIONER MILLER MADE A MOTION TO PAY BILLS IN THE AMOUNT OF $76,561.99 FOR GENERAL FUND, $77,545.19 FOR WATER & SEWER DEPARTMENT, AND $45,64.40 FOR OTHER FUNDS WITH A TOTAL OF $199,721.47 PAYABLE 02/10/2015. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER BURNETT, COMMISSIONER MILLER, AND MAYOR KRAFT. NAYS: 0.

COMMISSIONER MILLER MADE A MOTION TO APPROVE PAYROLL FOR PAY DATE 01/30/15 IN THE AMOUNT OF $54,652.69 FOR THE GENERAL FUND AND $28,026.11 FOR THE WATER AND SEWER DEPARTMENT FOR A TOTAL OF $82,678.80. SECOND BY COMMISSIONER BURNETT.

COMMISSIONER MILLER PRESENTED SEWER ADJUSTMENTS FOR CHARLES GUNTER OF 304 WEST CHURCH, NOEL POND OF 220 WEST ILLINOIS CENTRAL STREET, AND GREG BAIN OF 308 WEST PARK. COMMISSIONER MILLER MADE A MOTION TO APPROVE THESE SEWER ADJUSTMENTS. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER MILLER STATED HE HAS BEEN CHECKING WITH NEWWAVE AND COMPARING PRICES ON TELEPHONE SERVICE. HE STATED HE WOULD LIKE COUNCIL APPROVAL TO MOVE FORWARD WITH HIS RESEARCH. THE COUNCIL AGREED.

MAYOR KRAFT PRESENTED A RESOLUTION AUTHORIZING EXECUTION OF A SERVICE AGREEMENT WITH THE LOWEST RESPONSIBLE BIDDER FOR THE SUPPLY OF ELECTRICITY FOR RESIDENTIAL AND SMALL COMMERCIAL RETAIL CUSTOMERS WHO DO NOT OPT OUT OF SUCH A PROGRAM. COMMISSIONER WYANT MADE A MOTION TO APPROVE RESOLUTION 15-3. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 5. MAYOR KRAFT HELD A DISCUSSION ON LIMITING CLASS “C” LIQUOR LICENSES TO FIVE. COMMISSIONER BAUMGARTE MADE A MOTION TO 21 LIQUOR CODE, ARTICLE II –LICENSES CLASS “C” – TO FIVE. MAYOR KRAFT HELD A DISCUSSION ABOUT THE ARHITECTS THAT HAD SUMBITTED INFORMATION TO THE COUNCIL REGARDING THE CITY HALL PROJECT. COMMISSIONER MILLER MADE A MOTION TO SELECT WHITE AND BORGOGNONI AS THE ARCHITECTS FOR THE CITY HALL PROJECT. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER BURNETT, COMMISSIONER MILLER, AND MAYOR KRAFT. NAYS: 0.

UNDER OLD BUSINESS, COMMISSIONER WYANT MADE A MOTION TO RESCIND RESOLUTION 15-1, SALE OF PROPERTY AT INDUSTRIAL PARK II TO TEE JAY INTERNATIONAL. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER BAUMGARTE, COMMISSIONER WYANT, COMMISSIONER BURNETT, COMMISSIONER MILLER, AND MAYOR KRAFT. NAYS: 0.

IN MATTERS FROM THE PUBLIC AUDIENCE, NANCY FREELS STATED SHE HAS BEEN WAITING FOR THE STREET DEPARTMENT TO COME HELP WITH THE FLOODING IN HER YARD DUE TO CLOGGED DITCHES. COMMISSIONER WYANT STATED THAT HE WOULD GO BACK TO THAT NEIGHBORHOOD THIS WEEK AND CLEAN THE DITCHES AGAIN.

KEVIN MONTGOMERY HAD A COMPLAINT ABOUT THE BARS IN THE CITY LIMITS ALLOWING SMOKING. HE SAYS THAT HIS BAR IS LOSING BUSINESS BECAUSE HE AND HIS WIFE COMPLY WITH THE SMOKING BAN AT THEIR ESTABLISHMENT AND THE BARS IN TOWN DO NOT COMPLY. MAYOR KRAFT STATED THAT HE WOULD INQUIRE WITH BICOUNTY HEALTH CONCERNING ENFORCEMENT.

COMMISSIONER BURNETT MADE A MOTION TO GO INTO EXECUTIVE SESSION FOR (C) DISCUSSION OF POSSIBLE APPOINTENT, EMPLOYMENT, COMPENSATION, DISCIPLINE, PERFORMANCE, OR DISMISSAL OF SPECIFIC EMPLOYEES OF THE PUBLIC BODY OR LEGAL COUNSEL FOR THE PUBLIC BODY, INCLUDIG HEARING TESTIMONY ON A COMPLAINT LODGED AGAINST AN EMPLOYEE OF THE PUBLIC BODY TO DETERMINE ITS VALIDITY. COMMISSIONER BURNETT ALSO ASKED THAT DONALD T. RICHARDSON STAY FOR EXECUTIVE SESSION. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 5.
