MINUTES OF THE REGULAR BENTON CITY COUNCIL MEETING HELD MONDAY APRIL 24, 2017 AT
6:00 P.M. IN THE BENTON MUNICIPAL BUILDING LOCATED AT 1403 SOUTH MAIN STREET, BENTON, ILLINOIS.

MAYOR KONDRITZ CALLED THE MEETING TO ORDER. THOSE PRESENT WERE COMMISSIONER MILLER, COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ.

COMMISSIONER MILLER MADE A MOTION TO APPROVE THE MINUTES OF THE APRIL 10, 2017 PUBLIC HEARING. SECOND BY COMMISSIONER WYANT. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER MILLER, COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER MILLER MADE A MOTION TO APPROVE THE MINUTES OF THE APRIL 17, 2017 SPECIAL CALLED MEETING. SECOND BY COMMISSIONER STOREY. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER MILLER, COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0.

MAYOR KONDRITZ INVITED REG ANKROM OF SIMEC TO SPEAK TO THE COUNCIL REGARDING THE ELECTRIC AGGREGATION PROGRAM. MR. ANKROM THANKED THE COUNCIL FOR ALLOWING HIM TO HOLD A TOWN HALL MEETING PRIOR TO THE COUNCIL MEETING. HE STATED THAT IF ANY CITIZEN HAS QUESTIONS, THEY ARE WELCOME TO CONTACT HIM.

COMMISSIONER MILLER ASKED EVAN STEWART OF GET M.O.S.T. PEST CONTROL TO SPEAK TO THE COUNCIL REGARDING MOSQUITO CONTROL. MR. STEWART STATED THAT IF HIRED BY THE CITY HE WILL TREAT CITY OWNED AREAS FOR MOSQUITOS; HOWEVER, THE CITIZENS NEED TO BE TREATING THEIR PROPERTIES AS WELL. MR. STEWART STATED THAT HE WOULD BE USING TABLETS TO TREAT THE STANDING BODIES OF WATER AROUND TOWN AS HE DOES NOT FEEL THAT SPRAY WILL RID THE CITY OF MOSQUITOS.

COMMISSIONER BAUMGARTE MADE A MOTION TO APPROVE PURCHASE ORDER #001751 TO COE EQUIPMENT FOR A WARTHOG SEWER NOZZLE IN THE AMOUNT OF $2,430.00. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER MILLER, COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER WYANT MADE A MOTION TO DIRECT ATTORNEY TOM MALKOVICH TO PREPARE AN ORDINANCE FOR A NO PARKING TOW AWAY ZONE ON SOUTH MAIN FROM EAST CHURCH TO THE SQUARE ON THE EAST SIDE OF THE ROAD. COMMISSIONER WYANT MADE A MOTION TO DIRECT ATTORNEY TOM MALKOVICH TO PREPARE AN ORDINANCE FOR A NO PARKING TOW AWAY ZONE ON SOUTH MAPLE FROM WEST MAIN TO THE ALLEY ON THE WEST SIDE. VOTE WAS TAKEN. COMMISSIONER STOREY MADE A MOTION TO PURCHASE A K9 UNIT WITH MONEY PREVIOUSLY ALLOCATED FOR SAID PURCHASE. COMMISSIONER WYANT STATED THAT THE INSURANCE WILL BE APPROXIMATELY $30.00 A YEAR AND LIABILITY INSURANCE WILL NOT INCREASE. SECOND BY COMMISSIONER STOREY. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER STOREY STATED THAT HE WOULD LIKE TO PUBLICALLY THANK THE WATER DEPARTMENT FOR THEIR ASSISTANCE WITH THE HOUSE FIRE ON NORTH MCLEANSBORO THIS MORNING.

COMMISSIONER MILLER MADE A MOTION TO APPROVE PURCHASE ORDER #001044 TO AP EXCAVATING IN THE AMOUNT OF $3,800.00 FOR THE DEMOLITION OF A HOUSE LOCATED AT 220 NORTH MADISON. COMMISSIONER MILLER MADE A MOTION TO APPROVE PAYROLL FOR APRIL 21, 2017 FOR THE GENERAL FUND IN THE AMOUNT OF $59,614.48, WATER AND SEWER IN THE AMOUNT OF $27,418.00, AND AIRPORT CARETAKER IN THE AMOUNT OF $1,100.00 FOR A TOTAL PAYROLL OF $88,132.48. SECOND BY COMMISSIONER WYANT. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER MILLER, COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER MILLER MADE A MOTION TO APPROVE SEWER ADJUSTMENTS FOR TREVOR GIPSON OF 503 SOUTH MCLEANSBORO AND FRANCISCO CAMARGO OF 522 EAST SMITH AS THEY MEET THE CRITERIA SET FORTH IN THE ORDINANCE. SECOND BY COMMISSIONER BAUMGARTE. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER MILLER, COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0.

COMMISSIONER STOREY MADE A MOTION TO RETAIN GET M.O.S.T. PEST CONTROL FOR MOSQUITO CONTROL IN THE CITY OF BENTON. SECOND BY COMMISSIONER WYANT. VOTE WAS TAKEN. YEAS: 4. COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0. COMMISSIONER MILLER ABSTAINED.

MAYOR KONDRITZ MADE A PRESENTATION REGARDING RETURN ON INVESTMENT WITH VIDEO GAMING. MAYOR KONDRITZ STATED THAT VIDEO GAMING WAS A “GOLDEN EGG” AS THE CITY WOULD NOT HAVE TO INVEST ANYTHING AND WOULD STILL SEE A RETURN. MAYOR KONDRITZ STATED THAT TO NOT ALLOW VIDEO GAMING LICENSES IN THE CITY OF BENTON WOULD BE MONETARY INSANITY.

MAYOR KONDRITZ STATED THAT HE WOULD LIKE TO HAVE A MOTION APPROVING THREE (3) VIDEO GAMING LIQUOR LICENSES. COMMISSIONER STOREY MADE A MOTION TO APPROVE CREATING THREE (3) VIDEO GAMING LIQUOR LICENSES. MOTION DIED FOR LACK OF SECOND.

MAYOR KONDRITZ STATED THAT HE WOULD LIKE TO REAPPOINT LISA MENO TO THE POLICE PENSION BOARD. COMMISSIONER WYANT MADE THIS MOTION. SECOND BY COMMISSIONER MILLER. VOTE WAS TAKEN. YEAS: 5. MAYOR KONDRITZ STATED THAT A LETTER OF RESIGNATION HAD BEEN RECEIVED FROM DAVID MITCHELL FOR THE BENTON MUNICIPAL AIRPORT BOARD. COMMISSIONER BAUMGARTE MADE A MOTION TO ACCEPT THE RESIGNATION OF DAVID MITCHELL FROM THE BENTON MUNICIPAL AIRPORT BOARD. SECOND BY COMMISSIONER WYANT. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER MILLER, COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0.

MAYOR KONDRITZ STATED THAT HE WOULD LIKE TO APPOINT DARYL ICE TO THE AIRPORT BOARD VACANCY CREATED BY THE RESIGNATION OF DAVID MITCHELL. COMMISSIONER BAUMGARTE MADE A MOTION TO APPOINT DARYL ICE TO THE AIRPORT BOARD. SECOND BY COMMISSIONER WYANT. VOTE WAS TAKEN. YEAS: 5. COMMISSIONER STOREY, COMMISSIONER WYANT, COMMISSIONER BAUMGARTE, AND MAYOR KONDRITZ. NAYS: 0. COMMISSIONER MILLER ABSTAINED.

NO MISCELLANEOUS BUSINESS.

UNDER OLD BUSINESS, COMMISSIONER BAUMGARTE STATED THAT AT THE SPECIAL MEETING HELD ON APRIL 17, 2017, THE CITY OF BENTON WATER DEPARTMENT HAD HIRED BART BRADLEY. COMMISSIONER BAUMGARTE STATED THAT MR. BRADLEY HAS PASSED ALL TESTING REQUIRED FOR EMPLOYMENT. ALSO UNDER OLD BUSINESS, COMMISSIONER MILLER STATED THAT ALL DOCUMENTATION OF APPRAISALS OF CITY OWNED PROPERTIES HAVE BEEN RECEIVED AND AN AUCTION WILL BE SCHEDULED SOON. COMMISSIONER MILLER ALSO STATED THAT HE WILL BE CONTACTING DATALOCK IN MT. VERNON TO SCHEDULE A TIME FOR THEM TO SHRED ITEMS APPROVED BY THE STATE OF ILLINOIS.

IN MATTERS FROM THE PUBLIC AUDIENCE, DARYL ICE STATED THAT HE WAS HAPPY TO BEGIN SERVING ON THE AIRPORT BOARD AND ASKED FOR OPINIONS REGARDING WHAT SHOULD BE DONE WITH THE AIRPORT. WILLIAM MCPHERSON, OF THE BENTON GAZETTE, QUESTIONED VIDEO GAMING LICENSES. DAVE SCHMIDT WITH UNIVERSAL GAMING ASKED THE COUNCIL WHAT THEIR OPPOSITION TO ALLOWING VIDEO GAMING PARLORS IN THE CITY OF BENTON IS, NO RESPONSE WAS PROVIDED.
